These General Conditions, hereinafter referred to as the “rules,” govern the contract between the user and Sharma Climbing, S.L. (Carrer del Marroc, 204 – 08019 Barcelona – Spain, NIF: B66344839), hereinafter referred to as Sharma Climbing, and come into effect upon entering the facilities (both interior and exterior) of Sharma Climbing (hereinafter “facilities”).

The rules govern the use of the facilities of Sharma Climbing and participation in any activity of Sharma Climbing, including but not limited to the use of rope climbing walls, the bouldering area, fitness and climbing equipment, the rental or lending of equipment by Sharma Climbing, yoga classes, equipment testing, outdoor climbing clinics, events, competitions, or any other activity offered by or involving Sharma Climbing, in the facilities or elsewhere.

The climbing gym rules and the liability waiver agreement are part of the rules and set the conditions for the proper use of all Sharma Climbing facilities.

All courses (also referred to as specific activities, training sessions, classes, etc.) organized by Sharma Climbing are subject to the rules.

By participating in a competition or event organized by Sharma Climbing, competitors and spectators must comply with all the specific rules and restrictions of the event, in addition to the rules.

For groups, specific conditions may apply as previously notified, as well as the regular facility usage rules.

Failure to comply with these rules will result in automatic expulsion from the facilities and permanent cancellation of the user’s membership with Sharma Climbing, without compensation. Sharma Climbing reserves the right to limit or deny admission to the facilities for safety reasons or inappropriate behavior.

Informed Consent:

The user and/or legal representative acknowledges:

  1. The user acknowledges and understands that climbing (in any of its modalities, both outdoor and indoor) are sports activities not free from the risk of injury or death. These activities involve inherent and incalculable risks.
  2. The user is aware that the activity may cause accidents resulting in injuries that may require medical assistance.
  3. The user expressly accepts these risks, both known and unknown.
  4. The user is responsible for their own actions and consequences.
  5. The user enters and uses the Sharma Climbing facilities at their own risk.
  6. The user is aware that the organizer offers voluntary enrollment in a collective accident insurance plan, for an additional fee (between €1 and €24), which guarantees the coverage explained here.
  7. Should the user decide not to take the accident insurance, they voluntarily assume the cost of any medical assistance required (including transportation), arising from any accident, illness, or injury during the activity.
  8. The user authorizes the medical staff and other health personnel that the organizer may need to assist in case of an accident, illness, or injury, including the administration of any necessary treatment deemed necessary by the health authorities.
  9. The user understands that their participation in Sharma Climbing activities is voluntary.
  10. The user declares that they meet the physical and mental conditions necessary to use the facilities of Sharma Climbing and engage in any sport or activity at Sharma Climbing.
  11. Sharma Climbing guarantees the proper functioning of its facilities but is fully and expressly exempt from any eventuality, setback, difficulty, problem, injury, or accident resulting from training, climbing practice, or related dangers.
  12. For any damage or harm caused intentionally, Sharma Climbing reserves the right to claim compensation, which may be effective and binding on the heirs, closest relatives, family, guardians, executors, administrators, and assigns of the user in the event of their death. By signing this contract, the user unconditionally releases and discharges Sharma Climbing from any claims, compensation, obligations, and causes or rights of action, known or unknown, resulting from the user’s participation in Sharma Climbing activities, including claims for ordinary negligence. Furthermore, by signing this contract, the user agrees to indemnify Sharma Climbing for any third-party claims, obligations, or rights of action arising from their participation in Sharma Climbing activities.
  13. In the event of an accident, Sharma Climbing may provide first aid and arrange necessary medical assistance if the user is unable to make decisions for themselves. The user agrees to pay all costs incurred for Sharma Climbing to proceed in this manner. The user agrees to indemnify and hold harmless Sharma Climbing from any consequences resulting from such assistance.
  14. The opening hours and access restrictions vary depending on each center and may be reviewed both in the footer and on the official Google profile of each facility.

Access:

  • To access the facilities of Sharma Climbing, it is mandatory to register at the reception.
  • Each user must sign the informed consent agreement. By signing this document, each user accepts the rules. The user declares and guarantees that the personal information and bank details (if necessary) are correct and truthful and will keep them updated at all times. For minors, variations apply. See the section on rules for minors under 18 years old.
  • In case of closure or restricted access, no partial refund will be provided to members and holders of active passes.
    Sharma Climbing reserves the right to temporarily limit access to certain areas of the facilities for reasons such as classes, competitions, events, cleaning, repairs, wall maintenance, the setup of new climbing routes, or any other special event previously communicated.
  • Such access restrictions will be published and do not justify any refund of the entry or pass price.
  • Sharma Climbing may issue a membership card to its members or authorized users, which will identify the authorized holder.
  • In case of loss or theft of the membership card, the person to whom the card was issued must notify Sharma Climbing directly to have a new card issued and update the user’s account.
  • Sharma Climbing reserves the right to charge a fee for replacing the membership card. The amount of this fee will be determined by Sharma Climbing and made publicly available on the website.

Fees and Memberships:

  • All prices and conditions of each membership are available in the pricing section of each facility on our website, sharmaclimbing.com, and at the facilities. If you have any questions, you can inquire at the reception.
  • Any membership or pass is non-transferable and is linked to the profile of the person at the time of purchase.
  • All passes grant access to the public areas of Sharma Climbing facilities.
  • Day passes are only valid for the purchase date (the day of purchase by default).
  • Morning passes are valid for accessing the facility if purchased before 12:00 p.m. and allow access until 4:00 p.m.
  • Session passes have a predetermined expiration date of 365 days (except for promotions that may have a different expiration date, which will be published in each case).
  • Each day the facility is accessed will deduct one session from the pass, allowing entry and exit on that day.
  • Unused sessions after their expiration are non-refundable.
  • Session passes cannot be paused.
  • Recurring monthly memberships (contracts) renew automatically indefinitely the day after expiration and will be charged to the card or bank account provided by the client.
  • Recurring monthly memberships have a minimum commitment of 3 months from the date of the first payment.
  • Members who sign up for a new SEPA direct debit monthly membership must pay for the remaining days of the current month at reception. SEPA direct debit memberships start on the first day of each month and end on the last day of that month. Unused days are non-refundable.
  • For direct debit memberships, the proportional part of the current month’s fee must be paid at reception at the time of registration.
  • To cancel recurring memberships (SEPA or Credit Card), clients must do so from their personal area, before the issuance of the next monthly charge.
  • If requesting cancellation via the web form, it must be done before the 25th of the month prior to the desired cancellation date.
  • Any bank fees charged due to insufficient funds, rejected payments, or any other reason will be borne by the user (Sharma Climbing charges a fee of €5 for each failed payment).
  • Direct debit memberships can only be paused with a medical certificate justifying the pause. Sharma Climbing reserves the right to apply this pause based on the verified injury.
  • Recurring monthly memberships that benefit from a promotion (such as indefinite fee freezing or any other promotion) cannot be paused or stopped if the benefit is to be maintained. In the event of any pause or cancellation (temporary or permanent), the privilege will be lost.
  • Contracts with unpaid fees will be automatically canceled at the end of the month if the payment has not been regularized.
  • Customers with returned payments that have not been regularized by the end of the month may be prevented from using direct debit for future payments and will only be able to access the facilities via prepaid passes.
  • Prepaid passes of 30 days, 90 days, 180 days, or 365 days (or any other set duration) will expire on the last day of the subscription and will not automatically renew, so no cancellation is required.
  • Prepaid passes can only be paused with a medical certificate justifying the pause. Sharma Climbing reserves the right to apply this pause based on the verified injury.
  • Registration fees must be paid in cash or by card at the time of registration. Subsequently, monthly membership payments will be made via direct debit or charged to the customer’s card for automatic renewal each month.
  • Discounts for reduced fees are granted only with the presentation of a valid supporting document, and the discount must be renewed every year by presenting the document again at reception.
  • Only first-degree relatives with a valid supporting document can apply for the family rate.
  • In case of injury or illness (with a medical certificate), memberships can be suspended during the duration of the injury/illness, except for special memberships (e.g., lifetime fee freezing, memberships with a set expiration date).
    During the suspension period, normal member benefits and access to the facilities cannot be enjoyed.
  • Sharma Climbing reserves the right to review the prices and conditions at any time and notify clients at the facilities and on the website. The application of the conditions takes effect the day of registration for any prepaid or recurring contract or temporary access.
  • Any modification of the Sharma Climbing rules will take effect on the first day of the contractual period following the modification, unless the member decides to cancel under the previously mentioned conditions.

Courses and Classes:

  • Participation in the courses (classes, training, clinics, or similar) requires pre-registration and prepayment, and is subject to availability. Sharma Climbing members will have priority for signing up and/or additional benefits.
  • Sharma Climbing courses (training groups or children’s school) are recurring activities, and at the time of registration, the schedule for attendance must be selected.
  • To participate in the children’s school, adult training groups, or Team Sharma, a recurring payment (SEPA direct debit or credit card) is required, and the payment will be charged on the 1st of each month.
  • The children’s school requires payment of enrollment at the time of registration.
  • Courses and the school have a maximum capacity, and if full, there is an option to join the waiting list. If a spot opens, the course will be filled following the waiting list order.
  • The children’s school course starts in early September and ends in late June (specific dates for the entire course can be consulted in the annual calendar of each center).
    The children’s school does not have classes in July and August, and a new registration is required for the next course.
  • The training course for training groups starts in early September and ends in late July (specific dates for the entire course can be consulted in the annual calendar of each center).
  • The training groups only stop during the month of August, and a new registration is required for the next course.
  • You can cancel your direct debit for the children’s school, training groups, or Team Sharma at any time, before the 25th of the month prior to the desired cancellation, otherwise, the following month’s fee will be charged.
  • Equipment is not included in the training group or children’s school fees.
  • On public holidays, the school will not hold classes. These will include national holidays, regional holidays, and local holidays in each city. These days are listed in the activity calendar available on the website of each center.
  • One-off classes (birthday parties, private sessions, block/rope course, etc.) are not recurring and must be reserved (online or at reception) for a specific day and time, which must be chosen at the time of booking.
  • One-off classes may be rescheduled to another time, provided the request is made via email at least 24 hours before the activity starts.
    In case of cancellation of one-off classes, there are several scenarios:
    • If cancellation is made and notified via email more than 14 days before the activity, the full amount paid at the time of booking will be refunded.
    • If cancellation is made and notified via email between 14 and 5 days before the activity, 50% of the amount paid at the time of booking will be refunded.
    • If cancellation is made and notified via email less than 5 days before the activity, no refund will be issued.
  • For events, competitions, camps, etc., special cancellation conditions may apply, as listed in the activity rules. If none are specified, the above-mentioned conditions will apply.
  • Sharma Climbing reserves the right to modify or cancel courses at any time. In case of cancellation by Sharma Climbing, participants will be notified and fully refunded the amount paid.

Accident Insurance:

  • The accident insurance is an optional (not mandatory) service offered by Sharma Climbing to its users.
  • By accepting this, the user acknowledges that the organizer offers voluntary enrollment in a collective accident insurance policy, for an additional payment (between 1€ and 24€).
  • If the user decides not to purchase the accident insurance, they voluntarily assume the cost of all healthcare they may require (including emergency transportation) arising from any accident, illness, or injury during the activity.
  • In the event that a user without accident insurance suffers an accident that partially or fully impairs their ability to communicate, Sharma Climbing is authorized to request an ambulance or any other necessary emergency services. All costs associated with these services will be fully borne by the affected user.
  • Prepaid membership clients who purchased their membership before 01/01/2025 will have the insurance included by default, but they must choose to accept or decline it when acquiring a new membership.
  • Direct debit memberships starting before 01/01/2025 must decide whether to opt into the insurance or not by 01/03/2025. If no affirmative or negative response is received, Sharma Climbing will understand that they have declined the insurance.
  • The user authorizes doctors and other healthcare personnel that the organizer may require, if needed, to provide appropriate assistance in the case of any accident, illness, or injury, including the administration of any treatment deemed necessary by the responsible medical staff.
  • The insurance must be purchased along with the access package (day pass, session pass, monthly, annual membership, etc.) and cannot be purchased individually at a later time.
  • The insurance covers personal accidents caused by climbing, but may exclude causes or activities that are not allowed or that go against the center’s rules.
  • The coverage of this optional insurance does not include, among others:
    • Coverage for users who, at the time of an accident, are under the influence of alcohol or drugs, or those who are engaged in malicious acts.
    • Rental of sporting equipment, or its insurance.
    • Class fees.
    • Damage to third parties.

Rules for the Use of the Boulder Area

  • Always check the rules of each center and resolve any doubts with our technicians before climbing.
  • Not allowed:
    • Access for people under 13 years old (inclusive), except for guided activities with a technician or under the strict supervision of an adult in charge.
    • Eating and drinking on the mats, leaving equipment in the climbing area (shoes, clothes, etc.).
    • Climbing without a shirt.
    • Staying under the climbing area.
    • Climbing with a harness and climbing above the top of the boulders or in areas not designated for climbing.
    • Powdered magnesium.
  • Recommended:
    • Check that the climbing area is clear, do not jump from the highest points (use the descent rings and notify verbally).
    • Spot your partner and brush the boulders (brushes are available in the room).
    • Liquid magnesium in the boulder area.

Rules for the Use of the Rope Area

  • Always check the rules of each center and resolve any doubts with our technicians before climbing.
  • It is necessary to pass the safety test (this is mandatory and must be done at any of our facilities at any time) to obtain the corresponding certification to climb with a rope and auto-belay and/or belay with a rope: top rope or lead climbing.
  • The test must be done by a Sharma Climbing technician, and a card will be issued that must be hung from the harness and visible at all times.
  • The cards are:
    • RED CARD – Allows climbing only on auto-belays.
    • YELLOW CARD – Allows what is included in the red card, and also allows top rope climbing and belaying.
    • GREEN CARD – Allows what is included in the red and yellow cards, and also allows lead climbing and belaying.
  • Do not distract users while they are climbing, belaying, or in the process of putting on safety equipment (harness, knot, and checking).
  • Never stand under any user who is climbing.
  • For safety, do not use any climbing equipment, material, or technique without supervision from a Sharma Climbing staff member.
  • We recommend using magnesium balls or liquid magnesium to maintain a pleasant environment.
  • It is recommended to use a certified helmet for lead climbing or top rope.
  • Not allowed:
    • Interfering with the progress of routes being used by other climbers.
    • Climbing without a rope in the climbing route area.
    • Performing maneuvers at height (setting up belays, rappelling, safe descents, etc.).
    • Grabbing any metallic element during progression.
    • Climbing with headphones or any other device that limits hearing (unless medically prescribed).
    • Climbing with items or objects in pockets that may fall on other climbers.
  • Mandatory:
    • Use of semi-automatic or automatic belay devices (GriGri, GriGri2, or GriGri+).
    • Clip all the route protection points.
    • Always use certified material in good condition and perform a check-in with your partner right before starting to climb.
    • Tie into the harness with a double figure-eight knot.

Rules for the Use of the Auto-Belay Area

  • Always check the rules of each center and resolve any doubts with our technicians before climbing.
  • For safety, do not use any climbing equipment, material, or technique without supervision from a Sharma Climbing staff member.
  • We recommend using magnesium balls or liquid magnesium to maintain a pleasant environment.
  • It is necessary to pass the safety test (this is mandatory and must be done at any of our facilities at any time) to obtain the corresponding certification to climb with a rope and auto-belays and/or belay with a rope: top rope or lead climbing.
  • The test must be done by a Sharma Climbing technician, and a card will be issued that must be hung from the harness and visible at all times.
  • The cards are:
    • RED CARD – Allows climbing only on auto-belays.
    • YELLOW CARD – Allows what is included in the red card, and also allows top rope climbing and belaying.
    • GREEN CARD – Allows what is included in the red and yellow cards, and also allows lead climbing and belaying.
  • Not allowed:
    • Using a helmet.
    • Waiting in the fall line of the auto-belay.
    • Using the cable as a means of progression, jumping during descent, pendulum swings, etc.
    • Climbing routes outside the line where the auto-belay is installed.
    • Climbing with headphones or any other device that limits hearing (unless medically prescribed).
    • Climbing with items or objects in pockets that may fall on other climbers.
  • Mandatory:
    • Anchor the auto-belay to the ventral ring of the harness before starting to climb.
    • When finished, anchor the carabiner to the safety triangle ring.
    • If you have any doubts, ask any Sharma Climbing climbing technician.
      The rules for using auto-belays are set by the manufacturer.

Rules for Minors or People with Functional Diversity:

  • Minors or people with functional diversity may only access the Sharma Climbing facilities with the express consent of one of their parents or legal guardians, formalized by signing the waiver of responsibility agreement.
  • The minimum age for using the facilities is 4 years old. Children under this age can access the facilities free of charge as companions of a climber (parent, guardian, legal tutor, etc.) but are not allowed to climb or use the facilities.
  • Children between the ages of 4 and 15 may use the facilities after registering and signing a waiver of responsibility by their legal representative, who must remain on the premises while the minor uses the facilities.
  • Minors between 16 and 17 years old may use the facilities after registering and signing a waiver of responsibility by their legal representative, who is not required to be present at the facility while the minor uses it.
  • The legal representative agrees that the minor may use the facilities of Sharma Climbing and/or participate in any activity at Sharma Climbing and affirms they are the parent/guardian and waives their right, the user’s right, and the right of any other parent/guardian, to make any claim or sue Sharma Climbing for the minor’s participation in any activities or involvement in such activities.
  • Participation in activities will only be granted with written consent from the parents or legal guardian and the presentation of a valid ID.
  • Sharma Climbing reserves the right to deny entry to minors for reasons of safety or inappropriate behavior.

Rental of Equipment:

  • Rental of equipment must be done at the reception of the climbing gym and must be returned before leaving the premises.
  • Damages due to misuse of equipment will be charged to the customer, who must pay the replacement cost at the public sale price.
  • Any equipment rented at Sharma Climbing facilities is only for use within those facilities and cannot be taken outside the location where it was rented.

Personal Belongings:

  • Sharma Climbing is not responsible for any items that may be lost at any of the facilities, including items left in the lockers.
  • Sharma Climbing recommends that users do not bring or leave valuable items in the facilities or in the lockers.
  • Lockers are for daily use (except for customers who rent one). If a locker contains personal belongings when the facility closes (whether the locker is open or locked), it will be emptied, and its contents will be placed in lost and found until claimed.
  • All lockers at Sharma Climbing can be locked using a padlock, which is not provided or rented, and it is the customer’s responsibility to keep their belongings locked.
  • Items forgotten in lockers, changing rooms, or any other part of the facility will remain in lost and found for a maximum of 4 weeks. If not claimed within this period, the facility management will donate the items to a charity or dispose of them.

Data Protection:

  • In accordance with the Organic Law on the Protection of Personal Data 15/1999, the user’s data will be included and processed in a user file, managed by Sharma Climbing.
  • The user expressly authorizes Sharma Climbing to use their data for managing the users of the facilities, any activity of Sharma Climbing, as well as for conducting commercial information and marketing campaigns.
  • Users may exercise their right of access, rectification, cancellation, and opposition to their data by writing to the file manager and providing a photocopy of their ID or an equivalent document, in accordance with the law, to the responsible party: Sharma Climbing, S.L. (Carrer del Marroc, 204 – 08019 BARCELONA – Spain, NIF: B66344839).

  • Sharma Climbing may take photographs and videos in the facilities where clients may appear, and they will not be entitled to any compensation.
  • Photos and videos may only be taken for personal use, and not focused on any other clients who do not wish to appear in them.
  • Commercial videos and photographs not authorized by Sharma Climbing are prohibited. If you wish to take such media, please contact marketing@sharmaclimbing.com.
  • Recording videos and taking photographs in the changing rooms is strictly prohibited.

Notification of Defects:

  • Users are required to immediately inform Sharma Climbing staff of any deterioration or issues they observe.
  • This helps us create a safer environment for users and eliminate potential risks. Failure to report any issue will not invalidate a potential warranty claim. However, contributory negligence will be penalized.

Wi-Fi Usage Rules:

  • Sharma Climbing provides internet connectivity to users through the SHARMA PUBLIC network as their guest and under the responsibility of the person granting them access. This wireless connection is unrestricted with regard to web access.
  • To access the network, the user must accept the terms and conditions listed on the login portal.
  • Not all protocols are permitted within this infrastructure due to security policies.

Additional Provisions:

  • Sharma Climbing reserves the right to develop and modify the general conditions, climbing gym rules, liability waiver agreement, current fees, and any other legal document at any time. Such changes will take effect immediately after being published at the facilities.
  • The rules are governed by Spanish law. The invalidity or inability to enforce any provision of this contract will not affect the validity or applicability of any other provision, unless it impacts the essential quality of the rights and obligations of the parties (the user and Sharma Climbing) set out in this contract.
  • APPLICABLE LAW AND JURISDICTION: The provisions contained in these terms of use shall be governed and interpreted in accordance with Spanish law. Unless explicitly prohibited by law, for the resolution of all disputes arising from these terms of use, or relating to the non-compliance, interpretation, resolution, or validity of any provision of the website, the parties, by mutual agreement, submit to the jurisdiction of the courts of Catalonia, with an express waiver of any other jurisdiction that might correspond to them.
  • The full text of the rules, as well as any documents derived from it, have been drafted in Spanish, Catalan, and English, with the Spanish version being the official one for interpretation purposes.
