These General Conditions, hereinafter referred to as the Rules, govern the contract between the user and Sharma Climbing, S.L. (Carrer del Marroc, 204 – 08019 Barcelona – Spain,
NIF: B66344839), hereinafter referred to as Sharma Climbing, which come into effect upon entering the premises (both indoor and outdoor) of Sharma Climbing (hereinafter referred to as the Facilities).
The Rules govern the use of Sharma Climbing’s facilities and participation in any activity offered by Sharma Climbing, including but not limited to the use of roped climbing walls, bouldering areas, fitness and climbing equipment, rental or loan of equipment provided by Sharma Climbing, yoga classes, equipment tests, outdoor climbing clinics, events, competitions, or any other activity offered by or involving Sharma Climbing, either on-site or elsewhere.
The climbing gym rules and the liability waiver agreement form part of the Rules and establish the terms for the proper use of all Sharma Climbing facilities.
All courses (also referred to as occasional activities, training sessions, classes, etc.) organized by Sharma Climbing are subject to these Rules.
By participating in a competition or event organized by Sharma Climbing, competitors and spectators must comply with all specific rules and restrictions for the event, in addition to these Rules.
Specific conditions may apply to groups, which will be notified in advance, along with the regular facility usage rules.
Failure to comply with these Rules will result in automatic expulsion from the facilities and permanent removal as a client of Sharma Climbing without any compensation. Sharma Climbing reserves the right to restrict or deny admission to the facilities for safety reasons or inappropriate behavior
Informed Consent:
The user and/or legal representative acknowledges:
- The user acknowledges and understands that climbing (in any of its forms, whether outdoor or indoor) are sports activities not exempt from the risk of injury or death. These activities involve inherent and unpredictable risks.
- The user understands that the activity to be performed may result in accidents causing injuries that require medical or healthcare assistance.
- The user expressly accepts these risks, both known and unknown.
- The user is responsible for their own actions and their consequences.
- The user enters and uses the facilities of Sharma Climbing at their own risk.
- The user is aware that the organizer offers the option of voluntary enrollment in a group accident insurance policy, for an additional fee (ranging from €1 to €24), which provides the coverage detailed here.
- If the user decides not to purchase the accident insurance, they voluntarily assume the cost of all medical assistance they may require (including medical transport) due to any accident, illness, or injury arising during the activity.
- The user authorizes any medical professionals and other healthcare personnel that may be required by the organizer to provide adequate assistance in the event of an accident, illness, or injury, including the administration of any treatments deemed necessary by healthcare professionals.
- The user understands that their participation in Sharma Climbing’s activities is voluntary.
- The user declares that they meet the physical and mental conditions necessary to use the Sharma Climbing facilities and to engage in any sport or activity at Sharma Climbing.
- Sharma Climbing guarantees the proper functioning of its facilities but is fully and expressly exempt from any eventuality, setback, difficulty, problem, injury, or accident resulting from training, climbing activities, or related hazards.
- For any damages caused deliberately, Sharma Climbing reserves the right to claim compensation. This compensation may be enforceable and binding upon the heirs, closest relatives, family, guardians, executors, administrators, and assigns of the user in the event of their death. By signing this contract, the user unconditionally releases and discharges Sharma Climbing from any claims, compensations, liabilities, or causes of action, known or unknown, arising from the user’s participation in Sharma Climbing activities, including claims of ordinary negligence. Furthermore, the user agrees to indemnify Sharma Climbing against any claims, liabilities, or third-party actions resulting from their participation in Sharma Climbing’s activities.
- In the event of an accident, Sharma Climbing may provide first aid and organize necessary medical assistance if the user is unable to make decisions for themselves. The user agrees to pay all costs incurred for Sharma Climbing to act in this manner. The user agrees to indemnify and hold Sharma Climbing harmless from any consequences resulting from such assistance.
- Opening hours and access restrictions vary depending on each facility and can be reviewed in the footer or the official Google profile of each location.
Access:
- Registration at the reception desk is mandatory to access the facilities of Sharma Climbing.
- Each user must sign the informed consent agreement. By signing this document, every user accepts the Rules. The user declares and guarantees that their personal information and banking details (if required) are correct and truthful and will keep them updated at all times. Variations apply for minors. See the section on Rules for Users Under 18.
- In the event of closures or access limitations, no partial refunds will be issued to members or holders of active passes.
- Sharma Climbing reserves the right to temporarily restrict access to certain areas of the facilities for classes, competitions, events, cleaning, repairs, wall maintenance, the setting of new climbing routes, or any other special event previously communicated.
- Such access limitations will be published and do not justify any refunds for entry fees or active passes.
- Sharma Climbing may issue a membership card for its members or authorized users to identify the authorized holder.
- In the case of loss or theft of the membership card, the person to whom the card was issued must notify Sharma Climbing directly to have a new card issued and the user’s account updated.
- Sharma Climbing reserves the right to charge a replacement fee for the membership card. The fee amount will be determined by Sharma Climbing and made public on its website.
Memberships and Passes:
- Pricing and Conditions:
- All prices and conditions for each pass are available in the pricing section on our website, sharmaclimbing.com, and at the facilities. For inquiries, consult the reception desk.
- All memberships and passes are non-transferable and linked to the purchaser’s profile.
- All passes grant access to the public areas of Sharma Climbing facilities.
- Day and Morning Passes:
- Day passes are valid only on the day of purchase by default.
- Morning passes must be purchased before 12 PM and allow access to the facility until 4 PM.
- Session Passes:
- Session passes have a predefined expiration date of 365 days unless stated otherwise in promotional offers. Promotional offers may have different expiration dates but never exceed 365 days and will be clearly stated.
- Each day you access the facility, one session will be deducted from the pass, permitting unlimited entry and exit on that day.
- Unused sessions after the expiration date are non-refundable.
- Session passes cannot be paused.
- Recurring Monthly Memberships (Contracts):
- These memberships renew automatically indefinitely on the day after expiration and are charged to the card or bank account provided by the customer.
- A minimum commitment of 3 months applies, starting from the first payment.
- New members subscribing to SEPA direct debit will pay for the remaining days of the current month at reception. Memberships via SEPA start on the first day of the month and end on the last day. Unused days are non-refundable.
- Cancellation of recurring memberships must be done through the user’s personal account before the next billing cycle.
- For web form cancellations, the request must be submitted before the 25th of the preceding month.
- Bank fees incurred due to insufficient funds or rejected payments will be borne by the user, with a €5 fee per rejected payment.
- Memberships with promotional benefits (e.g., frozen rates) cannot be paused without losing these benefits.
- Prepaid Passes (30, 90, 180, or 365 Days):
- Prepaid passes expire at the end of their subscription period and do not renew automatically.
- They can only be paused with medical documentation proving an injury.
- Enrollment and Payments:
- Enrollment fees must be paid in cash or by card upon registration.
- Monthly payments are made via bank direct debit or card, renewing automatically each month.
- Discounts and Family Rates:
- Discounts are granted upon presenting valid documentation and must be renewed annually.
- Only first-degree relatives with valid documentation qualify for family rates.
- Injury or Illness:
- Memberships can be suspended during injury or illness with medical documentation, except for special passes (e.g., lifetime frozen rate memberships). During suspension, member benefits and facility access are not available.
- Policy Changes:
- Sharma Climbing reserves the right to revise prices and conditions and will notify members via the website and at facilities. Changes take effect on the first day of the subsequent contractual period unless the member cancels their membership.
Courses and Classes:
- General Information:
- Participation requires pre-registration, prepayment, and is subject to availability.
- Members have priority and additional benefits for courses.
- Courses (e.g., training groups, kids’ school) require selecting a specific schedule during registration.
- Specific Programs:
- The kids’ school and training groups operate from September to June. Kids’ school classes pause in July and August, requiring re-enrollment for the next school year.
- Training groups pause only in August, with re-enrollment needed for the next year.
- Cancellation of Recurring Payments:
- Cancellations for kids’ school or training groups must be made before the 25th of the preceding month.
- Single Sessions and Classes:
- Must be reserved for a specific date and time during booking.
- Can be rescheduled with at least 24 hours’ notice via email.
- Refund Policy for Cancellations:
- More than 14 days’ notice: Full refund.
- 14 to 5 days’ notice: 50% refund.
- Less than 5 days’ notice: No refund.
- Special Events and Activities:
- Specific cancellation policies for events, competitions, and camps may apply, otherwise adhering to the general rules.
- Course Modifications or Cancellations by Sharma Climbing:
- Sharma Climbing reserves the right to modify or cancel courses at any time, with full refunds provided in case of cancellation.
Accident Insurance:
- Accident insurance is an optional service (not mandatory) offered by Sharma Climbing to its users.
- By choosing to subscribe to this optional collective accident insurance, the user understands that an additional payment (ranging from €1 to €24) will guarantee the coverage explained here.
- If the user decides not to purchase the accident insurance, they voluntarily assume the cost of any medical assistance they may require (including medical transport) resulting from any accident, illness, or injury during the activity.
- In the event that a user who has not purchased accident insurance suffers an accident that partially or fully limits their ability to communicate, Sharma Climbing is authorized to request an ambulance or other necessary emergency services. All costs associated with these services will be fully borne by the affected user.
- The user authorizes the doctors and other medical personnel that the organizer may require to provide appropriate assistance in the event of any accident, illness, or injury, including the administration of any treatment deemed necessary by the responsible medical personnel.
- The insurance must be purchased along with the access pass (day pass, session pass, monthly, annual subscription, etc.) and cannot be purchased separately later.
- The insurance covers personal accidents caused by climbing, but may exclude causes or practices that are not permitted or that go against the facility’s regulations.
- This optional insurance coverage does not include, among other things:
- Coverage for users who are under the influence of alcohol or drugs at the time of the accident, as well as those involved in deliberate acts.
- Rental of sports equipment or its insurance.
- Cost of classes.
- Coverage for third-party damages.

Rules for Minors or People with Functional Diversity
- Minors or people with functional diversity can only access the facilities of Sharma Climbing with the express consent of one of their parents or legal guardians, formalized by signing the liability waiver agreement.
- The minimum age to use the facilities is 4 years old. Children under this age may access the facilities without an additional charge as a companion of a climber (parent, guardian, etc.), but they cannot climb or use the facilities.
- Minors between the ages of 4 and 15 can use the facilities with prior registration and signing of the liability waiver by their legal representative, who must remain in the facility while the minor uses it.
- Minors between the ages of 16 and 17 can use the facilities with prior registration and signing of the liability waiver by their legal representative, who does not need to be present in the facility while the minor uses it.
- The legal representative agrees that the minor can use the facilities of Sharma Climbing and/or participate in any activity at Sharma Climbing. The representative affirms they are the parent or legal guardian and waives their right, the user’s right, and the right of any other parent/guardian or person to make any claims or take legal action against Sharma Climbing for the minor’s participation in any activity at Sharma Climbing or their involvement in such activities.
- Participation in activities will only be granted with written consent from the parents or legal guardian and the presentation of valid identification.
- Sharma Climbing reserves the right to deny entry to minors for safety reasons or inappropriate behavior.
Equipment Rental:
- Equipment rental must be done at the reception of the climbing gym and must be returned before leaving the premises.
- Damage due to misuse of equipment will be charged to the customer, who must pay for the cost of the item at the retail price.
- Any equipment rented at Sharma Climbing facilities is only for use within those facilities and cannot be taken outside the location where it was rented.
Personal belongings:
- Sharma Climbing is not responsible for items that may be lost in any of the facilities, including those placed in lockers.
- Sharma Climbing recommends that users do not bring or leave valuables in the facilities or in the lockers.
- Lockers are for daily use (except for customers who rent one). If a locker contains personal items at the time the facility closes (whether the locker is open or locked with a padlock), it will be emptied, and its contents will be placed in lost and found until retrieved.
- All lockers at Sharma Climbing can be locked using a padlock, which is not provided or rented. It is the customer’s responsibility to ensure that all belongings are locked.
- Forgotten items in lockers, changing rooms, or any other part of the facility will be kept in lost and found for a maximum of 4 weeks. If not claimed by the owner within this time frame, the facility management will donate the items to a charitable organization or dispose of them.
Data Protection:
- In accordance with the Organic Law on Personal Data Protection 15/1999, the user’s data will be included and processed in a user file, the administrator of which is Sharma Climbing.
- The user expressly authorizes Sharma Climbing to use their data for the management of users of the facilities, any activity of Sharma Climbing, as well as for carrying out commercial information and marketing campaigns.
- Interested parties may exercise their right of access, rectification, cancellation, and opposition to their data by writing to the data controller and providing a copy of their ID or equivalent document, as provided by law, at: Sharma Climbing, S.L. - Sharma Climbing may take photographs and videos at the facilities in which customers appear, and the customers cannot request any remuneration.
- Photographs and videos may only be taken for personal use and should not focus on any other customer who does not wish to appear in them.
- Commercial videos and photographs not authorized by Sharma Climbing are prohibited. If you wish to take commercial photos or videos, you must contact marketing@sharmaclimbing.com.
- Taking videos and photos in the changing rooms is strictly prohibited.
Notification in Case of Defect:
- Users are required to immediately notify Sharma Climbing staff of any deterioration or problems observed.
- This allows us to create a safer environment for users and eliminate potential risks. Failure to notify any issues will not invalidate a possible warranty claim. However, contributory negligence will be penalized.
